Code of Conduct
Public Market and common consumption area rules
The City of Lenexa’s Public Market and Common Consumption Area (“Public Market CCA”) is located on the Lenexa civic campus at the southwest corner of 87th Street Parkway and Penrose Lane. The purpose of these rules are to ensure a safe, secure and enjoyable environment for all persons visiting the Public Market.
1. Public Market CCA Boundaries: The boundaries of the Public Market CCA are clearly marked by signs, physical barriers, and other apparent lines of demarcation. The Market Manager reserves the right to extend or contract the Public Market CCA boundaries.
2. Possession and Consumption Hours: The possession and consumption of alcoholic liquor within the demarcated boundaries of Public Market CCA is permitted daily between the hours of 6:00 a.m. and 12:00 a.m.
3. Removal of Open Containers: No open container of alcoholic liquor shall be removed from demarcated boundaries of the Public Market CCA.
4. Possession and Consumption of Outside Alcoholic Liquor: The possession and consumption of alcoholic liquor purchased outside of the Public Market CCA shall not be permitted within the boundaries of the Public Market CCA.
5. Branded Containers: All alcoholic liquor purchased within the Public Market CCA is served in a container that displays the Market Vendor’s trade name or logo or other identifying mark unique to such Vendor. Patrons are prohibited from removing, tampering with or otherwise altering any trade name or logo or other identifying mark placed upon a container of alcoholic liquor.
6. General Conduct Requirements: Visitors and patrons of the Public Market CCA are expected to:

Demonstrate common courtesy and respect towards other visitors, patrons, market vendors, and City personnel and volunteers;

Respect and follow these Public Market and CCA Rules, as well as any lawful instructions and/or directions given by Staff or other City personnel;

Discard refuse and place recyclables into their appropriate receptacles;

Avoid any conduct that unreasonably deprives others of their use or enjoyment of the Public Market CCA; and
-
Comply with all local, state and federal laws while in the Public Market CCA.
7. Inappropriate Conduct: Inappropriate conduct in violation of these Public Market and CCA Rules and/or failure to observe any other applicable laws, rules or regulations may subject the individual to disciplinary and/or criminal action depending on the nature, frequency, and severity of the offense. Inappropriate conduct includes, but is not limited to, the following:

Engaging in disorderly, disruptive, unsafe conduct or any conduct that interferes with the use of any facility, program or event by other patrons or visitors or with the functioning of market vendors, Staff or other City personnel. Such conduct includes, but is not limited to: brawling, fighting, physical abuse, inappropriate or unwanted physical contact, disruptive outbursts, use of profanity or indecent language, verbal abuse, harassment, spitting, gambling, and roughhousing.

The unauthorized use of any amplified sound that results in discomfort or annoyance to a reasonable person, including, but not limited to, cellular telephones, radios, music players, or other electronic devices;

Destruction, damage or theft of any market vendor or any City property, equipment or supplies or the property of other patrons or visitors.

Illegal drug or alcohol use;

Smoking (including the use of a vapor product) inside an enclosed public place or anywhere in the Public Market CCA except in designated smoking areas;

Committing any violation of law or City Code.
The above examples of unacceptable conduct are published for patrons and visitors’ information and serve as a guide for conduct within the Public Market CCA. The list is not intended to be all- inclusive, and various other circumstances may arise requiring disciplinary action.
8. Additional Restrictions: The City Manager may designate certain City personnel to implement additional restrictions in the Public Market CCA when determined appropriate because of crowd size, type of event, staffing availability, weather, or similar issues. Such additional restrictions may include but are not limited to: restricting areas within the Public Market CCA where alcohol may be possessed or consumed; restricting Public Market CCA hours for the possession or consumption of alcohol; implementing alcoholic drink size limitations or sales limits per individual; or requiring wrist bands to identify persons over 21 years of age.
9. Disciplinary Actions: Any violation of the Public Market CCA Rules may result in the following disciplinary actions, which are not exclusive and are not required to be implemented in a progressive manner:

Verbal warning of violation: A verbal warning is an oral notice of violation of the Public Market and CCA Rules or other lawful instruction and/or direction given by City personnel to an individual;

Immediate removal from the Public Market CCA: Immediate removal shall mean the removal of an individual from the Public Market CCA for the remaining hours of operation on the day of removal.

Suspension from the Public Market CCA: Suspension shall mean a temporary denial of access to the Public Market CCA for a period of one (1) or more days, but less than one (1) year. The effective date and length of the individual’s suspension shall be determined by the Public Market Manager or designee, depending upon the scope and severity of the violation. Notice of such suspension shall be made in writing.

Banishment from the Public Market CCA: Banishment shall mean a denial of access to the Public Market CCA for one (1) year or more. The effective date, scope and length of the banishment shall be determined by the Public Market Manager or designee, depending upon the scope and severity of the violation. Notice of the Banishment shall be made in writing.

Criminal Sanctions or any other remedy available under local, state or federal laws. The appropriate disciplinary action for any violation of these rules or other applicable rules will be determined in the sole discretion of City personnel. These disciplinary actions may be applied cumulatively. City personnel have the right to contact the Lenexa Police Department as it deems necessary.
10. Appealing a Disciplinary Action: Anyone who, in accordance with these rules, has been suspended or banished from the Public Market CCA for seven (7) or more days (the “Violator”) may appeal the suspension by submitting a written request (“Appeal”) to the City Manager or designee within five (5) business days of the date of the notice of any suspension or banishment (“Notice”). Appeals must be filed with the Lenexa City Clerk at Lenexa City Hall, 17101 W. 87th St. Pkwy., Lenexa, Kansas 66219 and must include any and all explanation and supporting documentation the Violator wants the City Manager to consider in making a determination.
Upon timely receipt of an Appeal, the City Manager or designee shall have five (5) business days to review the Appeal and issue a decision to (i) uphold the suspension or banishment or (ii) upon a showing of good cause, the City Manager may modify or lift the suspension or banishment. In making its determination the City Manager may contact the Violator and/or consult with City personnel to obtain additional information or clarification, but is not required to do so. The City Manager’s decision will be provided to the Violator in writing by placing it in the U.S. Mail and/or hand-delivery.
Public Market reserves the right to modify or amend the rules and procedure provided herein at any time.
